Digital Millennium Copyright Act — Copyright Infringement Policy

1. Introduction

Twiikle, Inc. (“Twiikle,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we have adopted this policy for responding to notices of alleged copyright infringement that comply with the DMCA and other applicable intellectual property laws.

Twiikle qualifies for safe harbor protection under 17 U.S.C. §512 as a service provider that hosts user-generated content. We will respond expeditiously to claims of copyright infringement committed using our platform when such claims are reported to our Designated Copyright Agent identified below.

This policy applies to all content hosted on Twiikle’s platform, including but not limited to videos, images, audio, text, and any other user-uploaded materials.

2. Designated Copyright Agent

In accordance with the DMCA, we have designated the following agent to receive notifications of claimed copyright infringement:

3. What Makes Twiikle Different

Unlike platforms that rely on automated content scanning, Twiikle takes a deliberate, creator-first approach to copyright enforcement. Our process is built on three core differentiators:

&circled1; No Content ID — All Claims Go Through Formal DMCA Process

Twiikle does not use automated content identification systems (such as Content ID). Every copyright infringement claim must go through the formal DMCA takedown process. This protects creators from false or automated claims that can suppress legitimate content such as fair use, commentary, criticism, and transformative works.

&circled2; 5-Step Verification — Filters Fraudulent Claims

Every DMCA notice submitted to Twiikle must pass our 5-Step Verification process (detailed in Section 4). This rigorous review filters out incomplete, fraudulent, or bad-faith claims before any action is taken against a creator’s content.

&circled3; Hide, Not Delete — Content Set to Private, Not Deleted

When a valid DMCA notice is received, Twiikle sets the content to private rather than permanently deleting it. The content is hidden from public view but remains intact. This ensures creators can file a counter-notification and have their content restored without data loss. Details in Section 5.

4. Five-Step Verification Process

All DMCA takedown notices must include the following five elements. Incomplete notices will be rejected and the reporter will be notified of any deficiencies.

Step Requirement Details
1 Reporter Information Full legal name, mailing address, phone number, and email address of the copyright owner or authorized representative. If filing on behalf of a third party, proof of authorization is required.
2 Identify Original Work A description of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works. Include URLs or other specific references to the original work.
3 Identify Infringing Content Identification of the material claimed to be infringing, including the specific URL(s) on Twiikle where the material is located. General references (e.g., “all my videos on your platform”) are insufficient.
4 Perjury Statement A statement, under penalty of perjury, that the information in the notification is accurate and that the complaining party is the copyright owner or is authorized to act on behalf of the copyright owner.
5 Electronic Signature A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. A typed full legal name with the intent to serve as a signature satisfies this requirement.

Notices that satisfy all five steps will be processed within 3 business days. The uploader will be notified immediately when their content is set to private.

5. Hide, Not Delete Policy

When Twiikle receives a valid DMCA takedown notice that passes the 5-Step Verification, the following actions are taken:

This approach satisfies the requirements of 17 U.S.C. §512(c) — the allegedly infringing material is made unavailable to the public — while preserving the content so that it can be restored if the claim is resolved in favor of the uploader. The DMCA requires that the service provider “remove, or disable access to, the material,” and setting content to private fully disables public access.

Why this matters: On many platforms, a single DMCA notice permanently destroys a creator’s work. Twiikle’s Hide, Not Delete policy ensures that no creator loses their content to a fraudulent or mistaken claim.

6. Counter-Notification

If you believe that your content was set to private as a result of a mistake or misidentification, you may submit a counter-notification pursuant to 17 U.S.C. §512(g). Your counter-notification must include:

  1. Your full legal name, mailing address, phone number, and email address.
  2. Identification of the material that was set to private and the URL where it appeared before being hidden.
  3. A statement under penalty of perjury that you have a good faith belief that the material was set to private as a result of mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Twiikle may be found), and that you will accept service of process from the person who filed the original DMCA notice or their agent.
  5. Your physical or electronic signature.

Counter-notifications should be sent to our Designated Agent at dmca@twiikle.com.

Timeline: Upon receipt of a valid counter-notification, Twiikle will forward a copy to the original claimant and inform them that the content will be restored in 10–14 business days unless the claimant files a court action seeking to restrain the user from engaging in the allegedly infringing activity. If no such court action is filed, the content will be restored to public status.

7. Three-Strike Policy

In accordance with 17 U.S.C. §512(i), Twiikle has adopted the following repeat infringer policy:

Strike Action Taken Details
1st Strike Video Set to Private The infringing content is set to private. The user is notified and informed of their right to file a counter-notification. No additional account-level penalties are imposed.
2nd Strike Video Set to Private + Warning The infringing content is set to private. The user receives a formal written warning that a third strike will result in account suspension. The user is informed of their right to file a counter-notification.
3rd Strike Account Suspended The user’s account is suspended. All content is set to private. The user may create a new account; however, any further DMCA violations will result in permanent ban. The user retains the right to file counter-notifications for any or all strikes.

Strikes are removed from a user’s record when a counter-notification is successful (i.e., the claimant does not file a court action within the 10–14 business day window). Strikes expire automatically after 12 months from the date of issuance.

8. Misrepresentation & False Claims

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees.

Warning: Filing a DMCA notice or counter-notification includes a statement made under penalty of perjury. Submitting false, fraudulent, or bad-faith claims may result in civil liability and criminal prosecution. Twiikle reserves the right to report suspected abuse of the DMCA process to law enforcement authorities.

Twiikle may also, at its discretion, suspend or terminate the accounts of users who repeatedly file false or abusive DMCA notices against other users.
